Our team can undertake individual lease extensions both statutory and voluntary and are well versed in dealing with all the major landlords including local authorities. Working closely with a select group of expert valuers and are often involved in the negotiation process. All deadlines are carefully watched and very few cases end up before the Tribunal.
We are adept in the operation of the 1967 Act whereby lessees can acquire freehold of houses. The team are experienced in dealing with mixed-use situations (part commercial part residential) where it is often possible to enfranchise the entire property. Graham has developed niche expertise in enfranchising very high-value houses in Central London.
We have undertaken large numbers of collective enfranchisements of blocks ranging from just two flats to very large blocks. On a few occasions, we have been successful in negotiating the voluntary acquisition of freeholds of small blocks.
However, enfranchising large complex blocks is very much our strength. We are involved in every step of the way from the first non-chargeable meetings with Committees right through the process until completion. We provide a truly comprehensive service and bring to the table all other required professionals – valuer, accountant, surveyor, engineer, insurance consultant, Counsel and others.
We invariably continue to act for the lessees after they have enfranchised and continue to provide them with a wide range of services, including dealing with Licences to Assign, Licences for Alterations, Breach of Covenant, Planning and Insurance Issues.
A large focus of our work relates to acting for tenants. We also act for a number of major property owners and investors on whose behalf we provide a wide range of services but principally in relation to enfranchisement matters where lessees seek either to enfranchise or obtain lease extensions.
This is an area where we have extensive experience in dealing with roof development which occasionally occur as part of a collective enfranchisement where an investor is brought on board who then undertakes a roof development which invariably provides significant benefits to the participating flat owners.
Graham has developed a widely recognised expertise in dealing the de-enveloping. This is the method by which UK residential property held in an offshore company can be transferred out of the name of the company into the name of share or shareholders. If the process is managed properly there is no liability to Stamp Duty Land Tax regardless of the value of the property. In complex cases Graham works with a specialist tax accountant.
