The Deceased attended hospital in a confused and agitated state. She was left unsupervised, fell fracturing her hip and sadly died a short time after surgery.

As a result of the fall the deceased suffered a fracture at the neck of her right femur necessitating a Right Hemiarthroplasty. Whilst it was noted that the surgery was without complication she sadly did not regain consciousness and died a short time later.
It was alleged that but for the fall she would not have died and despite co-morbidities she would have enjoyed many more years of life.
The Defendant investigated the matter and thereafter admitted liability in full as well as proving a formal written apology for the substandard care.
Following negotiations the Parties reached a negotiated settlement in which the Defendant agreed to pay damages in respect of pain and suffering, loss of love and affection as well as funeral expenses and the family’s legal costs. The case settled without the need for Court Proceedings to be commenced.
