Facts of the case

Our client was admitted to hospital for the birth of her child by caesarean section but suffered a post-partum haemorrhage requiring her to undergo a total abdominal hysterectomy.

At the time of the surgery her medical records were noted up stating that she required a sub total hysterectomy, a procedure whereby part of the womb is removed but the cervix remains, but her notes were not corrected when a  total abdominal hysterectomy was undertaken instead meaning the cervix was removed.

As a result of the error within her notes our client was advised that she would continue to require routine smears.

Having undergone two smears without any reference made, our client attended for her third routine smear at which time it became apparent that the smear could not be undertaken and she was required to undergo further attempts before a referral to a gynaecology assessment identified the error within her medical records and it was confirmed that she no longer required routine smears because she no longer had a cervix.

Not only had our client suffered the pain and discomfort that is well known in relation to smears but she also suffered psychologically upon the realisation that for the previous nine years she was living with the possibility of suffering cervical cancer, such anxiety only being alleviated once her periodic smear test results were available.

GAD Legal investigated the case and sent a Letter of Claim to the Defendants alleging that our client had undergone unnecessary and intrusive investigations.

The Defendants accepted there had been errors made within the notes and made a preliminary offer to settle the claim of low value.

We continued in negotiations with the Defendants setting out the full extent of the impact the error had had upon our client over the years, which we considered they had not fully appreciated.

The claim was settled to the satisfaction of our client without the need for court proceedings.
