Good news for claimants in hip metal device actions

Gregory Abrams Davidson (GAD) LLP has become one of just five specialist solicitors in the country to be included on a steering committee to lead litigation against DePuy, the company behind Pinnacle, a metal hip device that has been subject to a large number of high profile legal actions across the World.

GAD, which has its headquarters in Liverpool with additional offices in London is one of the UK’s leading specialist solicitors handling hip litigation, already acting for more than one hundred DePuy (xxxxx xxxxx xxxxx) ASR clients.

Lisa Lunt, head of clinical negligence is leading the Pinnacle litigation team that have been involved with the cases since the recall of the product in August 2010.

She said: “This is very good news for our clients because the committee includes the best product liability solicitors and barristers in the country.

“It will also mean that all Pinnacle clients eligible to register will get access to some of the best experts in the country, irrespective of where they reside.”

“A group litigation order (GLO) was approved at the end of July by the president of the Queens Bench Division at the High Court of Justice in London. This will ensure consistency in the management of all cases and in the decision-making process.

The GLO applies to all claims for personal injury, loss and damage arising out of the implantation ofDePuy Pinnacle Acetabular Cups and DePuy Pinnacle Metal on Metal Liners, combined with any metal femoral head, mated with any metal femoral stem.

Ms Lunt added: “A Group Litigation Order can be made in any claim where there are multiple parties or claimants to the same cause of action.

“Ultimately, people who have had a Pinnacle hip revised or have been recommended for revision by their Surgeon should contact us at GAD immediately. We have a dedicated legal team set up to provide you with specialist help and advice. It’s also important that people don’t delay getting in touch because there will be a ‘limitation period’ in their case that may be due to expire.”

Eligibility criteria for registration under the GLO:

        that you were implanted with a DePuy Pinnacle Cup

        DePuy Pinnacle metal on metal liner

        Combined with any femoral head and

        Any metal femoral stem

In addition to the above eligibility criteria, we are only seeking clients who have been implanted with:

  1. DePuy Pinnacle Acetabular cup and
  2. DePuy Pinnacle Metal on Metal liner combined with
  3. an articul/eze femoral head or an S-Rom femoral head (head size 36mm or more)
  4. a Corail AMT femoral stem or an S-Rom femoral stem.

Clients fitted with the Pinnacle metal on metal device have reported the following problems:

  • pain
  • swelling
  • fluid collections around the joint (pseudo-tumour)
  • nerve damage
  • muscle damage
  • bone damage
  • high metal ion levels
  • loosening of the device

The Order will provide for the case management of claims which gives rise to common or related issues of fact or law. These are specified in the Order as the ‘GLO Issues’.

A Group Register will be set up and maintained in the Management Court, consisting of all the parties to the group of claims being managed.
