The Conveyancing Process

Offers

If an estate agent is selling the property, the buyer must make an offer through the estate agent. Where it is a private sale, the buyer can make an offer directly to the seller. Any offer made is not legally binding until contracts have been exchanged. If an offer is made subject to contract, the price may still be negotiated at a later stage.

Contracts

Once an offer has been accepted, it is the responsibility of the seller's solicitor or estate agent to draw up the contract for sale to transfer ownership of the property. There may be a process of negotiation around the detail of the legal contract. When the buyer and seller are happy, both parties will sign the contract, and send a copy to each other. When the contracts have been exchanged, the agreement is legally binding.

Completion

At the stage of completion, the money for the property is transferred from buyer to seller, and the legal documents are handed to the buyer. The seller will also leave the property on the date set out in the contract, and hand over the keys to the buyer.

What are the costs involved in conveyancing transactions?

There are two elements to the costs of a property transaction – the fees we charge for doing the work, and the payments we have to make in order to carry out the transaction for you.

Our fees, and the payments we make on your behalf, will depend upon the value of the property, the nature of the transaction and where the property is located. We will always make sure that you are fully aware of all of the charges that apply.

How long will it take?

We will always try and make sure that your property transaction takes no longer than is necessary. However, the length of time may be dependent upon factors outside of your or our control.

The average process takes between 8-12 weeks. Sometimes, if it is a simple transaction without a long chain of related transactions, then it might be quicker. However, if there are several parties involved and a long string of transactions, it might take longer.

For example, if you are a first-time buyer, purchasing a new build property with a mortgage that has been agreed, it could take 8-10 weeks. However, if you are buying and selling a property and those to whom you are selling have not had a mortgage approved or those from whom your buying have problems with their related transaction then it can take considerably longer. This may also be reflected in the price that we need to charge – especially if substantial negotiations are involved.
